Dial Up Terms and Conditions

apply to your use of the Internet access service (Service).
The Service is provided as part of the Connect Dial-up
Access product produced by Axia Computer System Limited(Referred to in this agreement
which we supply with our products). Please
ensure that You read this material before proceeding.
Our Responsibilities
--------------------------------------------------------------------------------------------------------- We shall provide You with
the Service which comprises interactive dial up access
to the Internet including computer resources, disk storage
and computer communication facilities. The Service shall
be generally available 24 hours a day, seven days a week
with the exception of service maintenance times which
We shall advise to You from time to time. We will provide You with
aUser
ID code, unique password,
telephone number and other log-in
information that is required
to enable connection to the Service.
Your Responsibilities
---------------------------------------------------------------------------------------------------------- You agree to obtain, install
and maintain suitable equipment as is necessary to access
the Service.
You agree not to assign or otherwise transfer this Agreement
or your rights under it, delegate your obligations or
resell the Service.
You are responsible for the selection
and use of security features, non-disclosure of personal
log-in information and any information back up. Disclosure
or loss of log-in information that incur charges or Service
misuse is your responsibility and should be reported to
Us as soon as possible.
You indemnify Us from and against all
actions, claims, suits, demands, liabilities, losses,
costs and expenses arising out of or in any way connected
with your use of the Service.
IMPORTANT:
KEEPING YOUR ACCOUNT ACTIVE
--------------------------------------------------------------------------------------------------------- Axia suspends
any accounts that have not beenused for three months.
An account is deemed in
use if a customer has dialled into a CONNECT Point of
Presence (POP). If a non-CONNECT ISP is used to access
your CONNECT email over a three month period, this will
not be considered an active account.
If you wish to keep your account active, ensure you dial
into your account at least once every three months through
a CONNECT POP.
While your account is suspended
you cannot dial in,your
personal web page(if
you have one) will remain visible and any new email will
be stored. Account charges apply during suspension. To
reinstate your suspended account, call 03 9251 3600 and
ask for the accounts department. There is no charge for
reactivating a suspended account.
Following one week of suspension the
account is cancelled.
When your account is cancelled you can
not dial in, your web page is no longer visible and no
new mail is collected. Your account does not attract any
charges during this time.
Three months after your account is cancelled,
all stored email, your web page and any other files relating
to your account are deleted.
Charges:
-------------------------------------------------------------------------------------------- We retain the right to alter these
charges from time to time and such alterations shall be notified
to You by the giving of one month's written notice by e-mail.
By registering, You agree to pay the charges via credit card, details
of which are nominated by You, which shall be debited automatically
with a monthly service provision fee and usage fees at the end of
each charge period. Should this credit card number expire or should
We otherwise be unable to debit valid charges to this credit card
number, We may immediately and without notice with draw your access
to the Service. You are responsible for all use of the Service accessed
through you user password.
General Terms:
-------------------------------------------------------------------------------------------- We may monitor or keep any records
that We deem necessary of your use of the Service. The use of
the
Service is at your sole risk and is entirely your responsibility.
We do not and cannot monitor the content and information accessed
on the Service and We shall not be held responsible in any way
for any content of information accessed on the Service. You must
rely
on your own judgment.
We do not warrant that the Service will be uninterrupted or error
free, nor do We make any warranty as to the results obtained from
the use of the Service. The Service is provided without warranties
of any kind, either express or implied, other than those warranties
implied into this agreement by legislation such as the Trade Practices
Act and which cannot be excluded. To the extent permissible by law,
We exclude all liability for any direct, indirect, special or consequential
damages arising out of the supply or use of the Service or inability
to use the Service and where such liability cannot be excluded,
We limit our liability at our option to the resupply or cost of
resupply of the Service.
The Service
must not be used by any individual or group of persons for any activities
of an illegal or fraudulent nature.
Certain Internet content may contain
language or images which some individuals may find offensive, inflammatory
or of an adult nature. We do not endorse such materials and disclaim
any and all liability for their contents.
This Agreement shall remain in place
until it is terminated by either You or Us by giving one month's
signed written or e-mail notice. We reserve the right to terminate
the Service to You without notice if You misuse or abuse the Service.
